These Terms & Conditions (“Terms”) govern your use of www.dominiquelondon.de (“the Website”) and any purchases made from Dominique London Deutschland GmbH (“Dominique London”, “we”, “us”, “our”). By accessing the Website or placing an order, you agree to be bound by these Terms.

2. ELIGIBILITY AND AGE VERIFICATION

2.1 We do not market or sell tobacco products to anyone under 18 years of age (or the higher minimum age in your jurisdiction).

2.2 By using the Website or placing an order, you confirm you are of legal age where you reside and consent to our use of reasonable age-verification checks.

2.3 If you are not of legal age, you must not use the Website or purchase products.

3. HEALTH INFORMATION

3.1 Tobacco use is harmful to health.

3.2 You acknowledge that the use of tobacco products is at your own risk. To the fullest extent permitted by law, we are not liable for any health effects arising from tobacco use.

4. PRODUCTS, INFORMATION AND CONTRACT FORMATION

4.1 Product descriptions, photographs and specifications are indicative and may not always reflect the most recent packaging.

4.2 All products and prices displayed on the Website constitute an invitation to treat, not a binding offer.

4.3 After checkout, you will receive an automated order acknowledgement. This is not an order confirmation.

4.4 A contract is formed only when we confirm availability and issue an order confirmation or dispatch notice.

4.5 We reserve the right to refuse or cancel an order for reasons including unavailability, pricing errors or suspected fraud.

5. PRICES, CURRENCY AND TAXES

5.1 Prices are listed in Euros (€) and exclude delivery charges unless stated otherwise.

5.2 If a pricing error is discovered before dispatch, we may cancel the order and refund any amounts paid.

5.3 If you pay from a non-Euro bank account, your payment provider may apply conversion fees.

6. PAYMENT AND AUTHORISATION

6.1 By placing an order, you confirm that:

  • all payment information is accurate;
  • you are authorised to use the payment method;
  • you accept responsibility for all charges including product prices, shipping fees and any applicable taxes or import duties.

6.2 We may request further information to prevent fraud.

6.3 Your payment method may be charged upon order submission.

6.4 Payments are processed securely by approved third-party providers. We do not store or view full card numbers.

7. SHIPPING, DELIVERY TIMES AND RISK

7.1 Products are typically shipped in original manufacturer packaging, including bands where applicable.

7.2 Estimated (non-guaranteed) transit times:

  • Germany: approx. 2–4 business days
  • Rest of world: approx. 15–20 business days

7.3 Delivery times may vary depending on postal and customs services.

7.4 Risk of loss transfers to you upon delivery or first attempted delivery.

8. CUSTOMS, DUTIES AND IMPORT COMPLIANCE

8.1 You are responsible for ensuring that the purchase and import of tobacco products complies with the laws of your country.

8.2 You are responsible for all customs duties, taxes, brokerage fees and delays.

8.3 You confirm that you understand your local import rules before ordering.

9. DELIVERY GUARANTEE AND EXCEPTIONS

9.1 If a shipment is confirmed lost by the carrier, we will reship your order or issue a refund.

9.2 The delivery guarantee does not apply if non-delivery results from:

  • an incorrect or incomplete address;
  • failure to update address details;
  • repeated unsuccessful delivery attempts;
  • tracking showing “delivered”;
  • customs seizure or refusal;
  • issues within your control.

9.3 If products are returned to us in good condition, you may request a refund subject to a 10% administrative fee, plus shipping costs and any charges incurred.

10. UNDELIVERED ORDERS — NOTIFICATION PERIOD

If your order does not arrive, you must notify us within 30 days of shipment.

After this period we cannot file a claim with the carrier and accept no responsibility for non-delivery.

11. CANCELLATIONS, RETURNS AND RESTOCKING

11.1 You may return unused items in original packaging within 14 days of receipt for a refund or credit (delivery costs excluded).

11.2 All approved returns are subject to a 10% administrative fee, plus shipping costs, unless the goods are faulty or misdescribed.

11.3 Return shipping costs are your responsibility unless the item is faulty or substitutes were sent.

11.4 The cancellation policy does not apply if damage arises from misuse, negligence, alteration, improper storage or handling.

11.5 Your statutory consumer rights under EU and German law remain unaffected.

11.6 Returns must be sent to our German address unless we instruct otherwise.

12. PRODUCT IMAGERY AND VARIATIONS

12.1 Packaging may vary from images shown.

12.2 Minor variations in presentation do not constitute misdescription where the correct product line, brand and quantity are supplied.

13. WEBSITE USE

13.1 You may use Website materials for personal, non-commercial purposes only.

13.2 You may not:

  • create a database using Website material;
  • redistribute content without permission;
  • remove copyright or trademark notices;
  • upload unlawful, offensive or harmful content;
  • interfere with Website functionality or introduce malware.

13.3 Website usage, downloads and interactions are undertaken at your own risk.

14. ENTIRE AGREEMENT AND CHANGES

These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and Dominique London.

We may update these Terms at any time by posting the revised version on the Website.

15. LIMITATION OF LIABILITY

15.1 To the fullest extent permitted by law, our total liability relating to any order is limited to the amount paid for the products, including original shipping where applicable.

15.2 We are not liable for indirect or consequential damages, including loss of profit, income, goodwill or data.

15.3 Nothing excludes liability where such exclusion would be unlawful under applicable German or EU law.

16. COMPLAINTS

If you have a complaint, please contact us at info@dominiquelondon.com, including your order number and full details.

We aim to acknowledge complaints within 3 business days and address them within 7 business days.

17. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Germany.

You agree to the exclusive jurisdiction of the courts located in Nürnberg, Bayern, without prejudice to any mandatory consumer protection rights you may hold under EU law.
